Home daycare licensing in Idaho

What it takes to run a licensed home daycare in Idaho — who regulates it, how many children you can care for, and what an inspector checks.

Who regulates home daycare in Idaho

Idaho Department of Health and Welfare, Division of Family and Community Services is the state agency responsible for licensing or registering home child care in Idaho.

Idaho is one of the lighter-touch states in the country: family child care homes serving 6 or fewer children are exempt from state licensing altogether, and can legally operate with no license at all — highly unusual next to states like Iowa or Kansas that require registration well below that threshold. The tradeoff is that a provider who wants to grow past 6 kids into the 7–12 range crosses a hard line into mandatory 'Group Daycare Facility' licensing.

License types and capacity

License-exempt Family Child Care Home

6 or fewer children — exempt from state licensing entirely, though a provider can voluntarily opt into licensure.

A true solo 4–8-kid provider can potentially operate without any state license at all if she stays at 6 or fewer.

Licensed Group Daycare Facility

7 to 12 children — licensing becomes mandatory at this size.

The tier most solo providers aiming for 7–8 kids will actually need; requires an assistant at higher headcounts.

Child-to-caregiver ratios

Roughly 1:6 (adult:child) where a ratio requirement applies to family child care; the licensing structure otherwise runs on flat capacity caps.

Background checks

Fingerprint-based criminal history background check through Idaho's Background Check Unit, covering the provider and every household member age 13 and older — includes FBI criminal history, sex offender registry, and child abuse registry checks.
